By using Petitio you agree to all the terms below.

The web pages available at Petitio and all linked pages (“Site”), are owned and operated by a French registered Consultant and is accessed by you under the Terms of Use described below (“Terms”).

Please read these terms carefully before using the services. By accessing the site, viewing any content or using any services available on the site (as each is defined below) you are agreeing to be bound by these terms, which together with our Privacy policy, governs our relationship with you in relation to the site. If you disagree with any part of the terms then you may not access the site.


Description

We develop an online petition platform and provide services to create online petitions and we will develop more features and services in the future. The service may be interrupted for technicals reasons.

Petitio is a platform that allow you to create and host petitions ("Petition"). All gathered signatures remains on the platform (i.e. on its database), and you can have access to those signatures depending on your Plan (see Free/Pro Plan below). As a platform, Petitio is just a technical supplier that solves for you the problems of gathering signatures and retrieving them, you remain the publisher of your own petitions, including the signature forms, and are responsible for any use you make of it.

Your access to and use of the Site may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair of the Site or any other reason within or outside the control of Petitio. Petitio reserves the right to suspend or discontinue the availability of the Site and/or any Service and/or remove any Content at any time at its sole discretion and without prior notice. Petitio may also impose limits on certain features and Services or restrict your access to parts of or all of the Site and the Services without notice or liability. The Site should not be used or relied upon for storage of your petition and email lists and you are directed to retain your own copies of all Content gathered by the Site.


Registration

To fully use the services you need to create your own account, without violating other peoples' rights.

As a condition to using Services, you are required to open an account with Petitio and select a password and username, and to provide registration information. The registration information you provide must be accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your Petitio account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

You are responsible for maintaining the confidentiality of your password and are solely responsible for all activities resulting from the use of your password and conducted through your Petitio account.

Services are available only to individuals who are either (i) at least 18 years old, or (ii) at least 14 years old, and who are authorized to access the Site by a parent or legal guardian. If you have authorized a minor to use the Site, you are responsible for the online conduct of such minor, and the consequences of any misuse of the Site by the minor.


Petitions published

Your petitions are under your own responsibility. We can stop your petitions at any time if we judge that they do not conform with the French law.

The platform being currently hosted in France, french law regarding private data shall be respected: you must ensure a sufficient level of security on that data (i), you must inform your signatories on the duration of data conservation (ii), you must allow the signatories to delete their signatures (iii), you must publicly name a precise goal for gathering the signatures (iv), and you must declare yourself to the french governmental entity named "CNIL" if you plan to gather "sensible" data such as named sexual orientation, named political opinions, etc. (v). Petitio ensure you a total compliance with (i) and (iii), and it remains under you responsibility to comply with (ii), (iv) and (v). You are aware that to prevent you from any legal risk, your petition can be put offline on our sole discretion if we judge that you do not comply with (ii), (iv) and (v), not depending on your Plan.


Free Plan

We offer a free Plan with limited functions.

We offer a Free Plan limited to one petition with some limitations: you can't change the template (i), you can't download the signatories (ii), you can't host your petition outside of Petitio's domain (iii) and you can't tweak the default signature form (iv). Your petition remains fully powered by the rest of the platform technical niceties: real-time signatures, signature validation and Facebook/Twitter/Google+ integration.

Free Plans can be upgraded any time you want: your petition is transformed into a Pro petition right after having paid the upgrade fee. Upgrade fee is number of month your petition has been active multiplied by the Pro Plan monthly fee: 75€.


Pro Plan

We offer a Pro Plan at 75€/month for one petition and a reduced price for additional petitions (25€/month/petition).

We sell a Pro Plan at 75€/month which allow you to publish one petition. Additional petitions can be purchased at 25€/month/petition as long as you are paying one petition at full price. Those buying rules are implemented via a token system ("Token"): buying token is possible once you're logged into your account's backend, your customer profile is credited with number of tokens bought, which you can then affect to your petitions.

Affecting a token to a petition can activate a currently inactive petition for one month ("Monthly Period") (i), or prolongate the petition's activation period for one more month after its current activation period (ii). Token affectations are immutable are token bought cannot be refunded.

Monthly periods are unbreakable and correspond to the period until the same day's number of the activation day's next month, which is irrelevant to the number of days in a given month. For example, if you activate a petition on January 15th, then your petition will be active until February 15th 23:59. A end of month remains a end of month: an activation on January 31th will end on February 29th or 28th depending on the year being a leap one or not.


Fair Usage

We may limit your usage of the platform depending on the available resources

Our platform use technologies that suits mass signature saving: Mongodb, Redis, Node.js, etc. Saving hundred of signature per hour should not be a problem. However it remains possible that your activities on the platform could reach its limits and in doing so endangering the system stability for other customers. We will contact you in that case and propose you a solution that: may limit your usage in different way that depends on our sole discretion (i), or offers you extra resources against more tokens (ii).


Limitation Of liability

As a technical supplier, Petitio can not be found liable of any problem cause to a third person by your petitions

You hereby expressly and irrevocably release and forever discharge Petitio, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the Site and the Services.

You hereby agree to indemnify and hold harmless Petitio, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and attorneys' fees, resulting from or arising out of (i) a breach of these Terms, (ii) Content posted on the Site, (iii) the use of the Services, by you or any person using your account or Petitio Username and password, (iv) the sale or use of your email lists, or (v) any violation of any rights of a third party.


Termination

We may stop providing services at any time. You can stop using your account or close it at any time as well.

Petitio may terminate or suspend any and all Services and/or your Petitio account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your Petitio account, you may simply discontinue using the Services. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

It is your responsibility to remove all Content from your account prior to termination. Upon termination of your account Petitio may keep some of your petitions publicly accessible on read-only mode and with the Free Plan template.


Change

If these terms of use change, we will notify you.

Petitio reserves the right, at its sole discretion, to modify or replace the terms at any time. If the alterations constitute a material change to the terms, Petitio will notify you by posting an announcement on the site. What constitutes a material change will be determined at Petitio’s sole discretion. You shall be responsible for reviewing and becoming familiar with any such modifications. Using any service or viewing any content following notification of a material change to the terms shall constitute your acceptance of the Terms as modified.
